<p> TOKYO - The Japanese broadcaster Fuji TV sued former dot-com luminary Livedoor on Monday for $292 million in damages over losses it absorbed after buying a stake in the since disgraced Internet portal company. The lawsuit, filed by Fuji Television Network Inc. in Tokyo District Court, seeks compensation for the loss in value of nearly 134 million Livedoor shares the Tokyo-based broadcaster bought in 2005 for 44 billion yen ($373 million) as part of an alliance.</p>
<p>Fuji took a substantial loss when it later sold the shares to Livedoor&#8217;s new partner, Usen Corp., for about 9.5 billion yen ($80.5 million). Livedoor Co. shares plunged after the company was raided by prosecutors last year, its top executives were arrested on charges of securities laws violations, including falsifying earnings, and the shares were delisted.</p>
<p>Earlier this month, the Tokyo District Court found Livedoor founder and former Chief Executive Takafumi Horie guilty of securities laws violations and sentenced him to two and a half years in prison. Horie has appealed the decision. Six other senior company officials have also been convicted on charges of securities laws violations.</p>
<p>Last week, the Tokyo District Court fined Livedoor 280 million yen ($2.4 million) &mdash; the largest fine ever in corporate Japanese history for violating securities laws. Its subsidiary Livedoor Marketing was fined 40 million yen ($338,000).</p>
<p>Livedoor has been trying to revive its business under new management, although its credibility has been damaged. Its new management has said it may sue Horie and other former managers for damages. Company officials were not immediately available for comment on the Fuji TV lawsuit.</p>
<p>The tough fines and prison terms being doled out to those at the center of the scandal are sending a strong message to companies that the government is taking a harder line against white collar corporate crime.</p>
<p>The Livedoor case has also prompted calls for clearer laws about stock trading as well as heavier penalties for falsifying earnings reports. Horie is widely perceived as having tested the legal loopholes and limits of Japanese securities laws.</p>
<p>James Post, management professor at Boston University, said the recent moves in Japan show an effort to crack down on cheating, but said Japan needs to show how restrictions will be enforced. &quot;Reasonable rules create level playing fields where each person has a chance to succeed,&quot; he said. &quot;Japan&#8217;s business community has a stake in showing positive stories of honest, successful entrepreneurs to offset the damage of Livedoor.&quot;</p>
<p>In a separate lawsuit, about 3,600 individual investors have sued Horie and Livedoor for damages, saying they were duped into buying falsely valued shares. Horie had been a celebrity for his gutsy takeover attempts and flamboyant lifestyle and had drawn a large number of individual investors to buy shares in the Internet company.</p>

<p> A Japanese court on Thursday sentenced the former chief financial officer of scandal-tainted dot-com company Livedoor to 20 months in prison for inflating earnings reports. Ryoji Miyauchi and other Livedoor executives were accused of using a complex set of such schemes to fabricate 5 billion yen, or $42.5 million, in profit. Tokyo District Court Judge Toshiyuki Kosaka has said Miyauchi was the chief architect of some of the schemes.</p>

<p>Two other Livedoor officials, Fumito Okamoto and Osanari Nakamura, were each given a 1 1/2-year term with a three-year suspended sentence. A third, Fumito Kumagai, received a one-year prison term with a three-year suspended sentence. Prosecutors had demanded a 2 1/2-year prison term for Miyauchi and 1 1/2-year terms for the three others. Miyauchi pleaded guilty, while the others pleaded guilty to most of the charges. The rulings came a week after the same court sentenced the company&#8217;s founder and former chief executive, Takafumi Horie, to 2 1/2 years in prison. Horie, who insists he is innocent &mdash; a rarity in Japanese trials &mdash; was convicted Friday on charges of securities laws violations.</p>
<p>While his 2 1/2-year sentence was shorter than the four years prosecutors had demanded, it was considered harsh because Japanese executives charged with such white-collar crimes generally avoid prison terms. Nearly all criminal trials in Japan end with guilty verdicts, with many suspects confessing to win lighter sentences. Horie, 34, has appealed. Many Japanese view the trials of Horie and the other former executives as a clear signal that authorities are intent about cracking down on dubious startups and policing new areas of potential securities laws violations.</p>
<p>Before his arrest in January 2006, Horie was admired for his aggressive get-rich-quick schemes and flashy lifestyle, and even praised as a symbol of a new breed of Western-style entrepreneurship &mdash; a major contrast with the staid conformity of the traditional business elite. Horie, a college dropout, had drawn widespread media attention for trying to buy a professional baseball team, taking over a media conglomerate and running for a seat in Japan&#8217;s parliament. He failed at all three efforts but became a celebrity often seen on TV. He became a millionaire by selling Livedoor shares at the height of their value.</p>
<p>The Livedoor debacle has prompted calls for clearer laws about stock trading as well as heavier penalties for falsifying earnings reports. Horie is widely perceived as having tested the legal loopholes and limits of Japanese securities laws.</p>

The defense team appealed the ruling shortly after the verdict. Horie, who pleaded not guilty, posted bail at $4.3 million, a court official said, speaking on customary condition of anonymity. Before his January 2006 arrest, Horie had been a celebrity in Japan, fascinating the public with his flashy buyout attempts of a professional baseball club and a media conglomerate.</p>

<p>During the trial, which began last September and has drawn intense Japanese media coverage, Horie had said he had been framed and accused prosecutors of having targeted him for standing out too much with his brash, unconventional business style. Chief Judge Toshiyuki Kosaka said Horie masterminded an elaborate network of decoy investment funds that were &quot;established for the purpose of evading the law&quot; and to &quot;manipulate <a href="http://www.livedoor.com">Livedoor&#8217;s</a> accounting.&quot; &quot;At that point, the prosecutors case was proven,&quot; he said in handing down the ruling.</p>
<p>Prosecutors had demanded a four-year prison term for the 34-year-old founder and former head of Internet services firm Livedoor Co., which Horie guided from unknown startup to household name. Nearly all criminal trials in Japan end with guilty verdicts, but executives charged with such white-collar wrongdoing generally get a suspended sentence, and avoid prison. At the end of his nearly two-hour statement, the judge had kind words for Horie, who had become a celebrity before his downfall. &quot;Although you may have been found guilty, it doesn&#8217;t mean that everything about you has been condemned,&quot; Kosaka said.</p>
<p>He told Horie he had received a letter from &quot;a parent with a handicapped child&quot; who was inspired by Horie&#8217;s dreams and had bought Livedoor stock and still has them. &quot;I want you to make up for what you&#8217;ve done and start your life anew,&quot; Kosaka said. Horie, dressed in a dark suit and tie, sat passively through most of the session, at times shuffling through papers on his desk. &quot;I am disappointed that our assertion was not accepted. I will keep on doing my utmost in my appeal,&quot; he said in a statement after the trial.</p>
<p>His chief lawyer, Yasuyuki Takai, said he feared the verdict will squelch young people&#8217;s drive to take up challenges. People who take up new challenges have no choice but to challenge legal ambiguities,&quot; Takai said at a news conference at the courthouse. He said the case was based on ambiguous evidence and the testimony of two former Livedoor executives who have already pleaded guilty to similar charges and are being used as key witnesses against their former boss and friend. The two key prosecution witnesses, including former Chief Financial Officer Ryoji Miyauchi, face charges of securities laws violations in a separate trial. A ruling is scheduled for that case March 22.&nbsp;&quot;I cannot understand why there is a prison sentence,&quot; Takai said. &quot;Regrettably, my disillusionment with the Japanese criminal justice system has only gotten worse.&quot; </p>
<p>Horie had drawn widespread media attention here as an outspoken millionaire challenging this nation&#8217;s corporate culture long been dominated by big-name companies that conducted business through a cozy network of group-linked companies. Horie was known for his cocky flamboyance that stood out among drab, old-fashioned executives, and his downfall stunned the nation. More than 1,600 people drew lots for 63 gallery seats to see the session. Some experts say companies like Livedoor that made aggressive acquisitions were just beginning to emerge, and Japan still lacked clearly defined laws to police such moves. </p>
<p>Horie tumbled from stardom when prosecutors raided his company last year and then arrested him. He was kept incarcerated for three months, but he did not sign a confession as most suspects tend to do in Japan, often to win lighter sentences. Some Livedoor shareholders were pleased by the verdict, saying it recognized the financial damages they suffered because of the fraudulent accounting. Livedoor, which operated an Internet portal and offered Web-related services, drew a large number of individual investors, partly because of Horie&#8217;s fame. Those investors, many of them amateurs at the stock market, took big losses when Livedoor shares nose-dived after Horie&#8217;s arrest and were later delisted. </p>
<p>About 3,600 individual investors have sued Horie and Livedoor for damages, saying they were duped to buy falsely valued shares. Chohei Yonekawa, who represents a group of investors, said Friday&#8217;s ruling will help their case. &quot;It shows guilt,&quot; he said. &quot;It is proper the verdict includes a prison term.&quot;&nbsp; In an interview with The Associated Press three months ago, Horie said he is now looking to build a new business for consumer space travel and is working with several people to develop a rocket in Tokyo.&nbsp;&quot;Bureaucrats just want people to keep working by the sweat of their brow, without thinking and putting their savings in the bank,&quot; he said then. &quot;That&#8217;s the way they think, and there&#8217;s not much anyone can do about it.&quot; </p>
